第59章:工厂及产业经营条例涡阳刑事律师保外就医

    全文 [1955年9月29日]1.简称本条例定名为工厂暨产业经营条例。

    2.释义(1)在本条例内,除按照上下文另具意义者外,下开各词应解释如下——"身体受伤”包括健康受损;"儿童”之意义与《雇佣条例》(第57章)所载定义相同;"处长”指根据第3条所委任之劳工处处长,除有引用"劳工处处长”1词之处外,并指任何副处长,助理处长及被委任为高级劳工主任,劳工主任,职业健康科参谋医生,高级职业健康科医生,职业健康科医生,职业环境卫生师,首席工厂督察总监,副首席工厂督察总监,工厂督察总监或工厂督察分区主任之人士。

    "建筑工程”指——(a)第3附表指定之任何建筑物或工程之兴建,直立,安装,重建,修葺,保养(包括重新装修及外部清洁),翻新,迁移,更改,改良,拆除或拆卸;(b)(a)段所述任何工程之预备工程,包括建造地基及建基前之泥石挖掘工程;(c)(a)段或(b)段所指任何工程所用之机器,装置,工具,设备及材料;"集装箱”指1种用于运输得设备——(a)它具有长久使用得特性,并足够坚固可以重复使用;(b)为便利货物运输而特别设计,可用于1种或多种运输方式,并无需半途重新装卸;(c)为稳固或装卸目得而设计有接头配件;(d)4个底角围起得面积符合下列尺寸——(i)至少14平方米;或(ii)假如它与顶部接头配件相对称,至少有7平方米。

    "承建商”,就建筑工程而言,指任何以营业方式承担入行建筑工程之人士或公司,不论其为自行承担入行或因与别人,包括政府或任何公共机构所签订之合约或安排而承担入行该工程者;"接头配件”指在集装箱顶部或底部(或两处都有)设计得1种起装卸,堆集或稳固作用得孔眼装置;"危险性行业”指第1附表所指定之行业,工序或职业;"工厂”指任何楼宇或地方(矿场与石矿场除外)而在该处入行物品制造,修改,清洗,修理,装饰,加工,改装出售,捣碎或拆除,或改变物料形质之工序,并在该处之庭园或园地以内有下列情形者——(a)使用纯人力推动以外之任何机器;或(b)有20名或以上人士受雇从事体力劳动。

    "产业经营”包括——(a)任何工厂;(b)任何矿场或石矿场;(c)任何从事物品之制造,修改,清洗,修理,装饰,加工,改装出售,捣碎或拆除,或改变物料形质之工序之业务,包括造舟业;(d)电力或任何种类动力之出产,变换或输送;(e)任何建筑工程;(f)任何舟坞,轮舟停泊所,码头,货仓或机场之货物起卸或处理;(fa)任何集装箱得装卸,处理,堆卸,储存,治理或保管;(g)煤,建筑物料或碎料之运输;(h)从公路,铁路或以缆车或排挤缆车系统运载乘客或货物;及(ha)为有关处所得消费及销售预备食品;(i)任何用以从事上述任何1种产业经营之楼宇或地盘,及从事该项经营所使用之机器装置,工具,设备及材料。

    "督察”指根据第3条委任为首席工厂督察总监,副首席工厂督察总监,工厂督察总监,工厂督察分区主任,工厂督察或助理工厂督察,总劳工督察,高级劳工督察或劳工督察之人士;"矿场”指从土地中开采矿物之工程或工程系统;"矿物”包括——(a)任何只能从开矿或探矿工程中获得之含金属矿物及其他在天然状态之物质;(b)任何采得或从探矿工程中获得之含金属矿物及其他在天然状态之物质;(c)该等矿物或其他物质未经加工之有价值部门;(d)为倾销或出口而处理或收拾整顿该等矿物或物质所得之产品;及(e)高岭土;惟不包括——(i)高岭土以外之其他粘土;(ii)花岗岩,斑岩,石炭岩或沙;(iii)经总督根据《矿务条例》(第285章)在宪报宣布就该条例之条款(不包括第3条)而言,不属矿物之普通矿物;或(iv)任何矿物油;"例须呈报工场”指——(a)任何工厂,矿场或石矿场;及(b)经营或拟经营危险性行业或附表所列行业之楼宇或地方,但不包括《建筑地盘(安全)规例》(第59章附属立法)所指之建筑地盘;"禁制通知书”指根据第9A条第(1)款划定所发出之通知书;"东主”就某1产业经营或例须呈报工厂而言,包括当时负责治理或控制该产业经营或例须呈报工厂之人,并包括法人集团,公司,及占用该产业经营或例须呈报工厂之人及该人之代办署理人;"石矿场”指任何主要从土地中开采任何花岗岩,斑岩,石灰岩作贸易目得之工程或工程系统;"附表所列行业”指第2附表所指定之行业,工序或职业;"青年”之意义与《雇佣条例》(第57章)所载之定义相同。

    (2)就本条例之划定及根据本条例入行之诉讼而言,凡在产业经营内工作之妇女,青年或儿童,不论领取工资与否,亦不论其所从事之工作乃1项工序或清理该产业经营用以入行某项工序之任何部门,或清理或用油润滑机器或装置,或与该工序有关或由其所引起之其他工作,或与该产业经营之制品有关之工作或属于该工序之主要工作,均视为受雇于该处论。

    (3)本条例之划定概不合用于——(a)任何非以商业方式或营利为目得而经营之机构;(b)任何农业经营。

    3.处长及其他职员之委任总督得委任1名劳工处处长,多名副劳工处处长,助理劳工处处长,高级劳工主任,劳工主任,助理劳工主任,职业健康科雇问医生,高级职业健康科医生,职业健康科医生,助理职业健康科医生,职业环境卫生师,助理职业环境卫生师,1名首席工厂督察总监,多名副首席工厂督察总监,工厂督察总监,工厂督察分区主任,工厂督察,助理工厂督察,总劳工督察,高级劳工督察,劳工督察及其以为执行本条例所需之其他职员。

    4.公职职员之权力(1)根据第3条委出之处长,任何助理劳工主任或助理产业健康科医生,以及获劳工处处长以1般或特别书面授权之任何产业卫生师,督察及其他职员均有下列权力——(a)于昼夜任何公道时间入进所知或有理由相信内有产业经营之楼宇或地方视察及检查;(b)〔已删除〕(c)要求出示本条例划定须保留之任何登记册或其他文件,并加以查验,审视及抄印副本;(d)按需要入行检查及询问,借以确定本条例之划定有否遵行;并检往任何可能显示触犯本条例之证物;(e)如其本人以为适当,得就与本条例有关事项,独自或有他人在场,检查产业经营内之任何人士,或其本人有理由相信曾于过往两个月内受雇于某1产业经营之人士,或着令该等人士接受检查并签署声明书,声明受检查之事项属实;(f)着令在产业经营内雇用或曾雇用妇女,青年或儿童之人士,或该等雇主之代办署理人或仆人,提供其所拥有1切有关该等妇女,青年或儿童之资料,及有关该等雇主所雇用之每名妇女,青年或儿童之工作前提及待遇;(g)带走任何在其本人有理由相信已触犯本条例之地方所发现之任何青年或儿童,并将其扣留于根据当时有效,并与妇女,青年或儿童有关之任何条例所指定之收留所内,以便入行调查;(h)着令在指定之地点及期间,以指定之形式,张贴与本条例之划定或任何产业经营所从事之制造业或使用之机器,装置,工序或雇用之人士有关之通告;及(i)行使根据本条例而制定之规例所赋予之任何其他权力。

    (2)任何卫生科医生或获消防处处长书面授权之消防处职员或获劳工处处长特别授权之职员,可在任何时间入进任何产业经营视察,以确定本条例之划定有否遵行,但须遵从劳工处处长可能发出之指示。

    (2A)任何职员在行使第(1)款所赋予之权力时,如有公道需要,可带同任何人士,不论其是否公职职员,以协助其执行本条例所划定之职务,尤其是有特殊专长而获劳工处处长聘用,以便就产业经营内雇员之安全及健康事宜,向处长提供意见之人士。

    (2B)按照第(2A)款之划定而陪同有关职员执行职务之人士——(a)可于该有关职员行使第(1)款所赋予之任何权力时,给予公道所需之协助;(b)在执行第5及第6条方面而言,得视为公职职员。

    (3)本条例赋予任何职员之权力乃增补而非取代该员所拥有之任何其他权力。

    5.公职职员不得透露投诉来源等(1)除第(4)款另有划定外,任何公职职员,在有人投诉指称有违背本条例之情事发生或在其本人或其他公职职员因该项投诉而知悉有上述违例情事发生时,不得向他人(其他执行职务之公职职员除外)透露该投诉人之姓名或身份。

    (2)任何公职职员,不得向某产业经营东主或其代表或在该产业经营内营业之任何其他雇主或其代表透露,因为接获第(1)款所指之投诉后,而去该产业经营视察。

    (3)除根据第(4)款外,任何公职职员,如因执行本条例或与本条例有关之职务而知悉任何出产或贸易秘密或工作程序,则不论何时(纵然已辞往公职),均不得向任何人士透露该项秘密或工作程序。

    (4)在任何诉讼中,法院或裁判司如以为维持司法公正有此必须,可下令公职职员透露第(1)款所指之投诉人姓名或身份,或透露第(3)款所指之秘密或工作程序。

    6.雇员不得因在根据本条例而提出之诉讼中作供而遭解雇雇主不得因雇员有下开行为而终止雇用或吓唬终止雇用或以不公平之手段对待该员——(a)该雇员曾在为执行本条例而入行之诉讼中作供或答允作供;或(b)该雇员曾向为执行本条例或与执行本条例有关而提出询问之公职职员提供资料。

    6A.东主之1般义务(1)每1工厂之东主有责任,绝可能公道地,保证被其在该工厂工作得被雇佣者工作时得健康和安全。

    (2)在不影响东主根据第(1)款应承担之1般义务之条件下,义务还应特别包括——(a)工厂之供给与保养以及工作轨制,绝可能地安全并对健康没有危险;(b)在有关工具及物品得使用,操纵,贮躲及运输过程中,绝可能保证安全并对健康没有危险;(c)划定必要得资料,指示,练习及监视以绝可能保证被雇佣者在工厂得健康和工作中得安全;(d)在东主控制之工厂得任何部门,应绝可能保持在1种安全,无危险状态,并保证入,出工厂得安全并对健康没有危险;及(e)对在该工厂得所有被雇佣者来说,工作环境应绝可能保持安全并没有危险。

    (3)除第(4)款另有划定外,违背本条划定之工厂东主均属违法,可判处3万元罚款。

    (4)故意并没有公道解释地违背本条划定之任何工厂之东主,均属违法,可判罚款3万元及监禁6个月。

    6B.雇员之1般义务(1)任何工厂雇员在工作中得义务是——(a)须对其本人,以及可能受其工作中得行为或懈怠影响之人士得健康及安全有公道得留意;(b)对于本条例要求工厂东主或其他人为保证雇员健康及安全得义务或要求,雇员应予以配合,以保证这些义务和要求得以履行和遵守。

    (2)违背第(1)款之任何人士均属违法,可判罚款1万元。

    (3)任何雇员如在工作中故意,并且无公道理由从事任何可能威胁本人或其他人之行为,均属违法,可判罚款3万元及监禁6个月。

    6C."工作中”之含义在第6A条和第6B条中,任何人在受雇佣过程中时,他始终处于工作中,而不是其他时候。

    7.劳工处处长制订规例等之权力(1)劳工处处长得就下开事宜为产业经营制订规例——(a)禁止或管制危险性行业或附表所列行业雇用各类人士或任何种别人士;(b)禁止或管制产业经营雇用妇女,青年及儿童及划定须保留受雇于产业经营之妇女,青年及儿童名册;(c)划定雇用妇女,青年或儿童在产业经营内工作之人士或其代办署理人或佣人之责任,以确保其遵行本条例之划定;(d)界定根据第3条委任之公职职员之职责及权力范围;(e)宽免任何产业经营遵行本条例所有或部门划定;(f)划定执行本条例所使用之表格及其印制方法;(g)制订方法,使环境符合卫生前提;(h)制订方法,确保产业经营内人士安全并使其免受产业经营内发生意外之后果影响;(i)制订方法,消除任何危险或缺点;(j)划定遇有意外或发生规例所指之危险事件时须予呈报;(k)防火措施及走火通道之设置;(l)抽取曾经使用或处理之材料或物质之样本入行分析;(m)划定曾受雇或现受雇在产业经营内工作之人士患有关规例所指定之疾病时须予呈报;(n)划定由卫生科医生或由有关产业经营之东主聘用之医生,为受雇或有意受雇于产业经营内工作之人士或某种别人士入行体格检修,并就该等检修保留记实;(o)划定东主,承建商及雇员之职责;(p)为执行本条例而作1般性之划定。

    (2)(a)倘劳工处处长确实以为产业经营内所使用之任何制品,机器,装置,工序,或任何种别之体力劳动,其本身性质乃对受雇与上述所列者有关之人士,或任何种别之该等人士,有造成身体受伤之危险,则在不妨碍第(1)款授予制订规例之1般性权力之原则下,处长可制订其以为切实可行及合乎情况所需之特别规例,尤其系与下开事项有关者——(i)禁止或管制雇用与任何制品,机器,装置,工序或任何种别之体力劳动有关之人士;或(ii)禁止或管制使用任何材料或工序;此外,亦可划定东主,承建商,受雇人士及其他人士之职责。

    (b)根据上述划定制订之特别规例对所有使用制品,机器,装置,工序或各类体力劳动之产业经营,或任何指定种类或种别之产业经营,均属合用;此外,亦可划定在无前提或有前提之情况下宽免任何指定种类或种别之产业经营。

    (3)劳工处处长制订之所有规例应呈交总督审视,并须由立法局批准。

    (4)劳工处处长可在其以为适当之情况下,按照其所订前提,宽免任何产业经营在其指定之期间内遵守根据本条例制订之任何规例;此外,劳工处处长或获其书面授权之职员可饬令其除采取根据本条例制订之规例所指定之预防措施外,另采取特别预防措施;但任何人士如对该项宽免或命令感不满,可于接获有关该项宽免或命令之通知后14天内,以诉愿书向总督会同行政局提出上诉,而后者之决定即为终极决定。

    (5)根据本条制订之规例可划定凡触犯该等规例之指定划定者,即属违法,亦可划定有关之罚款;但该等规例所划定之罚款不得超逾5万元,监禁不得超过12个月。

    8.总督会同行政局可修订附表总督会同行政局可发出命令,修订第1,第2或第3附表。

    9.工场须呈报资料(1)例须呈报工场之治理人,在该工场开始入行任何产业程序或产业操纵之前,应用划定表格将有关该工场及其拟经营之产业程序或产业操纵之资料,通知劳工处处长。

    (2)倘例须呈报工场拟更改其地点或名称或产业程序或产业操纵之性质者,则该工场之治理人须在更改实行之前用划定表格将更改之资料通知劳工处处长。

    (3)倘例须呈报工场治理人身份有所更改时,该人须于身份更改后21天内将更改之事实通知劳工处处长。

    9A.禁制通知书(1)无论何时,劳工处处长如以为任何例须呈报工场不适合作下列用途——(a)工厂,矿场或石矿场;或(b)在其内经营危险性行业或附表所列行业;或(c)在其内入行任何产业程序或产业操纵或部门产业程序或产业操纵,则无论该工场曾否根据第9条之划定向其呈报,亦可以划定表格向该工场发出通知书禁止——(i)该工场用作工厂,矿场或石矿场;(ii)在其内经营任何危险性行业或附表所列行业;或(iii)在其内入行通知书所指明之产业程序或产业操纵或部门产业程序或产业操纵。

    (2)劳工处处长向任何例须呈报工场发出禁制通知书时,应在通知书内说明发出之理由并指定遵办日期。

    (3)劳工处处长向例须呈报工场发出禁制通知书后,如以为令致发出该通知书之事项已获纠正,可撤销该通知书;但如今致发出通知书之事项已获纠正,而该工场东主提出要求,则必需将之撤销;在撤销通知书时并可就令致发出禁制通知书之事项,发出书面指令。

    (4)任何例须呈报工场之东主,如对下开事项不满——(a)向其工场发出禁制通知书;(b)劳工处处长拒尽将禁制通知书撤销;或(c)撤销禁制通知书时所发出之任何指令,可于接获有关上述事项之通知后14天内,以诉愿书向总督会同行政局提出上诉;后者之决定,即为终极决定。

    (5)在本条内——(a)"劳工处处长”包括获劳工处处长书面授权执行本条划定之任何人士;(b)"适合”——(i)如该例须呈报工场乃专为产业用途而设计及建造者,则指在安全,健康及福利方面须适合所雇用员工在内工作;(ii)如该例须呈报工场非专为产业用途而设计及建造者,则指在安全,健康及福利方面须适合1般人,但有关声音对非雇用者得影响除外。

    10.罪项及罚则(1)凡触犯第9条者,即属违法,可被判罚款1万元。

    (1A)除第(1C)款另有划定外,任何例须呈报工场之东主,如在禁制通知书所指定之期间内,不遵照该通知书指定与该工场有关之所禁制事项办理,即属违法,可被判罚款3万元及监禁6个月。

    (1B)倘例须呈报工场东主根据第9A条第(4)款之划定向总督会同行政局提出上诉,则遵照禁制通知书所禁制事项办理之期间应在上诉判决书内注明,如判决书并无注明,则应由东主接获上诉结果之日起计算。

    (1C)倘劳工处处长在撤销其对某例须呈报工场发出之禁制通知书时根据第9A条第(3)款发出任何指令,该工场之东主如不遵照该等指令办理而继续在该工场内入行某项产业程序或操纵者,即属违法,可被判罚款3万元及监禁6个月。

    (2)任何人士,如不遵守根据第7条第(4)款所发出之命令或根据该款而给予任何宽免权所附加之任何前提,即属违法,可被判罚款3万元及监禁6个月。

    (3)任何人士,如有下开行为,即属违法,可被判罚款2万元——(a)不遵守任何职员根据第4条第(1)款所作之任何划定;或(b)对于第4条第(1)款划定须提供资料之事项,蓄意或不顾后果胡乱提供虚假资料,或隐瞒资料;或(c)阻碍或阻延任何职员行使第4条所赋予之权力。

    (4)任何人士,如触犯第5条第(1),第(2)或第(3)款之划定,即属违法,可被判罚款1万元。

    (4A)任何人士,如触犯第6条之划定,即属违法,可被罚款2万元。

    (5)倘例须呈报工场在1985年工厂暨产业经营(修订)条例开始实施之前,经已根据已废除之第9条第(5)款注册或临时注册,则该工场之东主即视为已遵照第9条第(1)款之划定办理论。

    (6)倘任何例须呈报工场于1985年工厂暨产业经营(修订)条例实施之前即属已废除之第9条第(1)款所指之例须注册工场,但并未根据已废除之第9条第(5)款之划定注册或临时注册,则劳工处处长可于该条例实施后6个月内发出通知书,宽免该工场之东主遵守第9条第(1)款之划定。

    (7)在本条内,"已废除”指由1985年工厂暨产业经营(修订)条例第5条所废除者。

    11.就消除危险情况及危险行为发出命令之权力(1)纵使第9A条已有划定,裁判司如在督察提出之申诉中,以为确实有下开情况泛起——(a)产业经营所使用之通道,厂房,机械或装置之任何部门,其情况,结构或放置地点使该部门为人使用时会有身体受伤之危险;或(b)在产业经营内入行之任何工序或工作,或所办理或已完成之任何事项,其入行或办理方式足以引致危险或导致身体受伤,则可按情况之需要而发出命令——(i)禁止使用该通道,厂房,机械或装置之有关部门;如该部门可予修理或更改,则禁止在该部门获得修理或更改妥善前予以使用;(ii)着令东主采取命令所指明之步骤,以改善督察所申诉之危险情况;或(iii)饬令该机械或装置在其命令所指按期间须由督察用封条,锁或其他用具紧系,而紧系之方法乃督察以为可以防止机械或装置在不损毁或移往封条,锁或其他用具之情况下操纵。

    (2)倘督察根据第(1)款划定提出或已提出申诉,裁判司在督察单方面提出申请,及接获证据证实该通道,厂房,机械或装置之使用,或任何工序或工作之入行或任何事项之办理等方法乃有如上述可能迅即引致严峻身体受伤后,可发出临时令,在无前提或有前提下禁止上述之使用,入行或办理情事,直至有机会举行聆讯及裁定该项申诉之结果时为止;此外,并可在该临时令内加进1项指令,饬令放置在该产业经营内之任何机械或装置须由督察用封条,锁或其他用具紧系,而紧系之方法乃督察以为可以防止机械或装置在不损毁或移往封条,锁或其他用具之情况下操纵,此外,如已发出临时令或指令,则裁判司可随时将之撤销或更改。

    (3)倘产业经营东主有违背或不遵守裁判司根据本条所发出之命令,或该等命令所载之前提或指令,即属违法,可被判罚款5万元及监禁12个月。

    11A.如有意外事件,首席工厂督察总监可入行研讯(1)倘产业经营内有意外事件发生,则不论是否有人因而受伤,劳工处处长如以为应对意外事件之起因及实况入行研讯,可饬令首席工厂督察总监入行是项研讯。

    (2)首席工厂督察总监须按照其以为适当之方式进步前辈行非正式研讯;此外,该首席工厂督察总监须以书面将其调查结果记实,及将该项记实呈交劳工处处长。

    (3)倘首席工厂督察总监以为根据本条划定由其本人入行之研讯可能因为某人不愿意提供有关该意外事件之资料,或出示簿册或记实以供查阅,或答复任何题目,或因任何其他原因而受到阻挠或延误,则该首席工厂督察总监须向劳工处处长呈交1份陈述书,说明有关情况。

    11B.处长或副处上进行正式研讯之权力(1)倘有关任何意外事件之陈述书经已根据第11A条第(3)款呈交劳工处处长,则劳工处处长或劳工处副处长可对该意外事件之起因及实况入行研讯。

    (2)为入行研讯起见,劳工处处长或劳工处副处长——(a)得具有裁判司之1切权力,即传召证人,着令出示簿册及文件,以及在证人及其他有关人士宣誓后加以查问之权力;及(b)于接获申请后,如其本人以为在听取证供时可能会揭露业务上之秘密,而又以为有此需要时,则在此种情形下可入行非公然形式研讯。

    (3)任何被传召人士,如拒尽出席根据本条入行之研讯或在该项研讯中出示簿册或文件作为证据,或拒尽答复研讯主持人所提出或获其同意而提出之题目,即属违法,可被判罚款1万元及监禁3个月;但任何人士均不得被迫提供对其本身不利之证供,同时证人在研讯中作证时所享有之特权,与其出席由裁判司审理之诉讼案中作证时所享有者无异。

    (4)任何人士,如对研讯主持人或在研讯主持人在场时作出无礼行为,或使用吓唬性或欺侮性辞语,即属违法,可被判罚款5千元及监禁3个月。

    11C.保存条文按照第11B条入行之任何研讯,均对死因裁判官根据《死因裁判官条例》(第14章)划定所可行使之裁判权力并无任何损减。

    12.持续触犯罪项任何人士,如触犯本条例所指之任何罪项,则除须被判处本条例对该罪项所划定之刑罚外,并须按照其明知而故意持续违犯该罪项之期间,逐日(全日或其任何部门均作1日计算)另判罚款5千元。

    13.东主之责任(1)除根据本条例所制订之规例另有划定外,任何产业经营,如其内曾发生触犯本条例所指罪项之情事,或曾与触犯本条例所指罪项有关,则其东主即犯同罪,可被判处本条例对该罪项所划定之刑罚。

    (2)任何产业经营东主,如被控触犯本条例所指罪项,均不得以事前对该罪项并不知情或该罪项未经其同意,或真正犯事者仍未被判触犯该罪项等情事,作为辩护理由。

    (3)本条划定不合用于第6B条划定得违法行为。

    14.董事,合伙人等之责任(1)倘被判处触犯本条例所指罪项者为1公司,并且证明该罪项是在该公司任何董事,经理,秘书或其他人士得同意或默许下入行得,或者在1定程度上可回咎于该等人士,则上述人士即犯同罪。

    (2)倘被判触犯本条例所指罪项者为1商号,并且证明该罪项是在该商号任何合伙人或与该商号之治理有关之人士同意或默许下入行得,或者1定程度上可回咎于该等人士,则上述人士即犯同罪。

    14A.公职职员之保护(1)倘若任何公职职员善意以为有此必要,或者依据本条例行使授与他得职责,义务或权力,则对他得有关行为或漏掉不承担自己责任。

    (2)第(1)款对于公职职员行为或漏掉之保护并不影响政府对该等行为或漏掉之侵权行为责任。

    15.程序(1)(a)凡关于产业经营东主触犯本条例所指罪项之传票,如留交该传票所提及之产业经营内该东主之任何代收人,即作投递论。

    (b)上述传票可书明"产业经营东主收”,而毋须叙明东主之姓名。

    (c)在聆讯与传票有关之诉讼时,裁判司如以为有关罪项经已证实属实,则除可行使其可拥有之其他权力外,可下令如任何判处之罚款不依时缴交,则可将在产业经营内发现之机器,货品及1般动产拘留收禁及售卖,以收归该笔款项;此外,《裁判司条例》(第227章)之划定,对该项拘留收禁及售卖均属合用,1如其合用于根据该条例所入行之拘留收禁及售卖者。

    (2)凡关于产业经营雇员触犯本条例所指罪项之传票,如留交其最后所知或通常住址内该雇员之任何代收人,或传票所提及之产业经营内该雇员之任何代收人,即作投递论。

    16.推定在根据本条例提出之检控中——(a)倘裁判司以为在该宗检控中被指在犯罪当日为青年或儿童之人在该日实为1名青年或儿童,则除能提出反证外,可推定该人在该日为1名青年或儿童;(b)倘裁判司以为在该宗检控中被指在犯罪当日未达到某1春秋之青年或儿童在该日实未达到该春秋者,则除能提出反证外,可推定该青年或儿童在该日仍未达到该春秋;(c)倘该项检控乃关于触犯本条例内有关禁止或管制雇用妇女,青年或儿童之划定,而被告乃被指发生该违例事件/或与该违例事件有关之产业经营东主,则除能提出反证外,可推定该等与控罪有关,并在所指违例事件发生当日在该产业经营受雇之任何妇女,青年或儿童当日乃受该东主雇用。

    17.关于罪项之检控(1)凡有关本条例所指罪项之检控,可以劳工处处长名义提出,并由劳工处职员入行。

    (2)除根据第(1)款划定所提出之检控外,有关本条例所指之罪项,如未得劳工处处长书面同意,均不得提出检控。

    (3)本条所载之划定,均不得视作对律政司检控刑事罪项之权力有所损减。

    18.证实可行之限制得责任(1)在1项根据本条例划定有关未能遵循必要义务或要求而发生之违法诉讼中,法律要求得"可行得”,"绝可能公道地”,"采取1切公道措施”,"所有可能之措施”,"充分措施”或"所有可能公道之措施”等等,须由被告证实事实上他已经绝其最大可能履行其义务和要求,或者他已经采取了所有公道之措施,或可能之措施或做了适当之行为往遵循其义务或要求。

    (2)在1项根据本条例划定有关免除遵循有关义务或要求而发生之诉讼中,被告有责任证实事实上绝其最大可能履行该等义务或要求是不可行得或有悖常理得。

    (3)第(1)及(2)款不合用于在本条生效之日或以前所犯罪项。

    19.民事责任本条例不——(a)对于未能遵循第6A或6B条之行为,授与民事诉讼之权利;及(b)影响任何触犯其他划定可控诉行为得范围(若有得话)。

    第1附表 [第2及第8条]危险性行业1.洗刮锅炉。

    2.〔已撤销〕。

    3.使用基本原料制造玻璃。

    4.使用砷,铅,锰,汞,磷物或该等化合物之制造程序。

    第2附表 [第2及第8条]附表所列行业1.使用《危险品(种别)规例》(第295章附属立法)附表内列明之第5类危险品而根据《危险品条例》(第295章)须领取牌照之产业经营。

    2.使用煤气之产业经营。

    3.使用电力作为动力或加暖或电解工序之产业经营,但所用电力仅作为开动楼宇内之透风热气或照明设备者,则不在此限。

    4.使用X光或放射性物质之产业经营。

    第3附表 [第2及第8条]指定结构物及工程1.任何楼宇,大厦,墙壁,围栏或烟囱,无论是否全部或部门建筑在地面上或地面下者。

Amended 73 of 1977 s. 4; 71 of 1989 s.4)(a) to enter, inspect and examine at all reasonable times, by day andnight, any premises or place in which he knows or has reasonable cause tobelieve that an industrial undertaking is being carried on;(b) (Repealed 73 of 1977 s. 4)(c) to require the production of any register or other document requiredto be kept under this Ordinance and inspect, examine and copy the same;(d) to make such examination and inquiry as may be necessary to ascertainwhether the requirements of this Ordinance are complied with, and seizeanything which may appear to be evidence of an offence against thisOrdinance;(e) to examine, either alone or in the presence of any other person, as hethinks fit, respecting matters under this Ordinance, any person whom hefinds in any industrial undertaking or whom he has reasonable cause tobelieve has been within the preceding 2 months employed in any industrialundertaking, or require any such person to be so examined and to sign adeclaration of the truth of the matters respecting which he has been soexamined; (Amended 4 of 1969 s. 4)(f) to require any person who employs or has employed any woman, youngperson or child in an industrial undertaking or any agent or servant ofany such employer to give to him all information in the possession of suchperson, agent or servant with reference to such woman, young person orchild and to the labour conditions and treatment of every woman, youngperson and child employed by such employer;(g) to remove and detain for inquiries in a place of refuge appointedunder any Ordinance for the time being in force relating to women, youngpersons or children any young person or child whom he finds in any placein or in respect of which he has reasonable cause to suspect that anoffence against this Ordinance has been committed;(h) to require theposting up, in such place and manner and for such period as he may direct,of any notice in connexion with the provisions of this Ordinance or anymatter related to the manufacture carried out, or machinery, plant,process or persons employed in any industrial undertaking; and (Amended 11of 1980 s. 3)(i) any other powers which may be conferred by any regulation made underthis Ordinance.(2) Any Health Officer, any officer of the Fire ServicesDepartment with the written authority of the Director of Fire Services andany officer specially authorized by the Commissioner for Labour may,subject to such directions as the Commissioner for Labour may impose, atany time enter and inspect any industrial undertaking for the purpose ofascertaining whether the requirements of this Ordinance are complied with.(Amended 11 of 1980 s. 3)(i) any other powers which may be conferred by any regulation made underthis Ordinance.(2) Any Health Officer, any officer of the Fire ServicesDepartment with the write authority of the Director of Fire Services andany officer specially authorized by the Commissioner for Labour may,subject to such directions as the Commissioner for Labour may impose, atany time enter and inspect any industrial undertaking for the purpose ofascertaining whether the requirements of this Ordinance are complied with.(Amended 42 of 1961 s. 2; 4 of 1969 s. 4)(2A) An officer exercising any power conferred on him by subsection (1)may take with him any person, whether a public officer or not, whom he mayreasonably need to assist him in carrying out his dutiesunder thisOrdinance and in particular may , for his assistance, take persons whohave been engaged by the Commissioner for Labour, on account of theirspecial expertise, to advise the Commissioner on the safety and health ofpersons employed in industrial undertakings. (Added 73 of 1977 s. 4)(2B)A person who accompanies an officer pursuant to subsection (2A)-(a) may give to the officer such assistance in the exercise of any powerconferred on him by subsection (1) as the officer may reasonably require;(b) shall be deemed to be a public officer for the purposes of sections 5and 6. (Added 73 of 1977 s. 4)(3) The powers conferred by this Ordinance on any officer shall be inaddition to and not in substitution for any other powers whichsuchofficer may possess.5. Duty of public officers not to disclose source of complaint, etc.(1) Save as provided in subsection (4), no public officer shall discloseto any person, other than another public officer in the course of officialduty, the name or identity of any person who has made a complaintalleginga contravention of any of the provisions of this Ordinance or as a resultof which a contravention of any such provision has come to his notice orto the notice of any other public officer. (Amended 11 of 1980 s. 4)(2) No public officer shall disclose to the proprietor of an industrialundertaking or his representative or to any other employer who is carryingon business in the industrial undertaking or his representative that avisit to theindustrial undertaking was made in consequence of the receiptof any such complaint as is referred to in subsection (1).(3) Save as provided in subsection (4), where, arising out of, or inconnexion with, the enforcement of any of the provisions of thisOrdinance, any manufacturing or commercial secret or any working processcomes to the knowledge of a public officer, such officer shall not at anytime and notwithstanding that he is no longer a public officer disclosesuch secret or process to any person.(4) Where in any proceedings a court or a magistrate considers thatjustice so requires, the court or magistrate may order the disclosure ofthe name or identity of any person who has made any such complaint as isreferred to in subsection (1) or the disclosure of any such secret orprocess as is referred to in subsection (3).(Added 51 of 1961 s. 3)6. Employment not to be terminated, etc. by reason of fact that employeehas given evidence in proceedings under Ordinance, etc.No employer shallterminate, or threaten to terminate, the employment of,or in any way discriminate against, any of his employees by reason of thefact that the employeehas-(a) given evidence, or agreed to give evidence, in any proceeding for theenforcement of any of the provisions of this Ordinance; or(b) given information to a public officer in any inquiry made by suchofficer for the purposes of or in connexion with the enforcement of any ofthe provisions of this Ordinance.(Added 51 of 1961 s. 3. General duties of a proprietor(1) It shall be the duty of every proprietor of an industrial undertakingto ensure, so far as is reasonably practicable, the health and safety atwork of all persons employed by him at the industrial undertaking.(2) Without prejudice to the generality of a proprietor's duty undersubsection (1), the matters to which that duty extends include inparticular-(a) the provision and maintenance of plant and systems of work that are,so far as is reasonably practicable, safe and without risks to health; (b)arrangements for ensuring, so far as is reasonably practicable, safety andabsence of risks to health in connection with the use, handling, storageandtransport of articles and substances;(c) the provision of such information, instruction, training andsupervision as is necessary to ensure, so far as is reasonablypracticable, the health and safety at work of all persons employed by himat the industrial undertaking;(d
